Fitness to Practise Committee

The Fitness to Practise Committee hears and determines matters related to the alleged incapacity of College members. The parties to a hearing are the College and the member alleged to be incapacitated.

The Fitness to Practise Committee is responsible for determining if the member is suffering from a physical or mental condition or disorder that makes them unfit to carry out their professional responsibilities, or if their certificate should be made subject to terms, conditions or limitations.

If the panel finds that the member is incapacitated, they may, among other things:

  • lose their licence to teach
  • have their certificate suspended for up to two years
  • have terms, conditions or limitations put on their certificate
  • be told how long they will remain ineligible to teach before they can be reinstated.

Fitness to Practise Committee hearings are generally closed to the public. A hearing may be open if the member alleged to be incapacitated makes a request in writing to the Registrar for a public hearing before the hearing begins. The Fitness to Practise Committee may refuse the request under certain circumstances.
