The Discipline Committee ordered that the teaching certificate of Jagminder Singh Rai be suspended for engaging in nonconsensual touching of a sexual nature toward a colleague (Person A) and a member of the public (Person B).
Rai’s professional misconduct included touching Person A in a sexual manner without her consent. This occurred after Rai and Person A attended a school year-end house party with other school staff to celebrate the end of the school year.
Rai and Person A both consumed large amounts of alcohol throughout the evening. Some of the school staff members rented a limousine to take them from the party to a bar, and back to their respective homes at the end of the night.
While in the limousine, Person A was lying down on the back seat with her eyes closed, while Rai sat alone in the back with her. At some point, Person A awoke to find Rai touching her breasts and vagina over her clothing. Person A sat up and used her hands to stop him from continuing.
Rai’s inappropriate conduct toward Person B occurred when Rai, along with members of his baseball team, attended a pub Rai regularly visited. Person B, who was working as a server that evening and had previously met Rai, joined Rai, some of his teammates, and other servers at another bar, when she finished work. There, they socialized and had drinks.
At the end of the evening, Person B called a taxi to go home and waited for an extended period at the back entrance. When Rai, who was giving a friend a ride, offered to drive her as well, Person B, tired from her day, accepted his offer.
After dropping off his friend, Rai drove Person B to her apartment. Upon arrival, Rai asked if he could come inside to use the washroom, have a drink, and watch a movie they had talked about earlier that evening. Person B was hesitant, but agreed, explaining that Rai would need to leave after the movie because she was tired. Inside, Person B poured drinks for them both and then sat down. Rai sat down beside her, close enough that their legs were touching.
When Person B moved away from him, Rai said, “That’s rude. I don’t bite” and moved closer to her. She again moved away, angling her body toward the television. Rai then attempted to massage Person B’s neck, shoulders, and back. Feeling uncomfortable, Person B asked Rai to stop. In an attempt to get Rai to leave, Person B pretended she was falling asleep. Instead, Rai moved closer to her, whispered her name and put his hand up her skirt, touching her thigh. Person B jumped from the couch and told Rai she wanted to go to bed and that it was time for Rai to leave.
Rai followed her toward the apartment door but attempted to enter her bedroom. While standing in the small entryway, Rai gave Person B a hug, kissed her, tried to put his tongue in her mouth, and rubbed his erect penis against her pelvic area before leaving.
During the time in question, Rai was employed as a teacher by the Thames Valley District School Board.
Rai, who was certified to teach in October 2002, attended the hearing on April 15, 2025, and had legal representation.
The Discipline Committee panel found Rai guilty of professional misconduct and ordered that his Certificate of Qualification and Registration be suspended for four months.
He was also directed to receive a reprimand.
In addition, he was directed to complete a course regarding sexual harassment, professional ethics, and appropriate boundaries with colleagues.
In their written decision, the Discipline Committee panel stated, “Even when members of the profession are off duty, they must still conduct themselves in ways which do not put the teaching profession into disrepute. [Rai] failed to do so by engaging in unwanted touching of a sexual nature with a colleague and with a member of the public. The public’s trust in the teaching profession is eroded when a member engages in such inappropriate behaviour that it undermines the reputation of the teaching profession.”
